1. About Us
These terms and conditions govern your use of our website and the purchase of products from Impact Detect. Impact Detect is based in the United Kingdom at Unit 8, Riverside 2, Campbell Road, Staffordshire, ST6 4RJ, United Kingdom. By placing an order with us you agree to be bound by these terms and conditions.
2. Orders and Contract
When you place an order you are making an offer to purchase products from us. All orders are subject to acceptance and availability. A binding contract is formed only once we have confirmed your order and payment has been successfully processed. We reserve the right to refuse or cancel any order at our discretion, including where a product is unavailable or where there is an error in the price or description of a product.
3. Pricing and Payment
Prices are displayed in pounds sterling (GBP) unless otherwise stated. Payments are processed securely by Stripe, our third-party payment provider. We do not store your full card details. By submitting a payment you confirm that you are authorised to use the payment method provided. We take reasonable care to ensure prices are correct; however, if we discover an error in the price of products you have ordered we will contact you to confirm whether you wish to proceed at the corrected price.
4. Taxes, Duties and Customs
We sell and ship our products worldwide from the United Kingdom. Where applicable, UK VAT and other charges will be shown at checkout. For orders shipped outside the United Kingdom, all applicable taxes, import duties, customs fees and related charges are the sole responsibility of you, the customer. These charges are levied by the destination country and are not included in the product price or delivery cost. We recommend contacting your local customs office for further information before placing an order.
5. Delivery
We deliver worldwide. Delivery times and costs are provided at checkout and are estimates only. Risk in the products passes to you on delivery. Any delivery dates are indicative and we are not liable for delays caused by third-party carriers or customs processing in the destination country.
6. Cancellations, Returns and Refunds
Orders may be cancelled free of charge at any time prior to dispatch. Once an order has been dispatched, it may only be cancelled or returned in accordance with these terms and any applicable statutory rights.
If you are a consumer, your statutory rights under applicable consumer protection legislation remain unaffected. Where you exercise a statutory right to cancel, you are required to take reasonable care of the goods whilst they are in your possession. If the value of the goods has been diminished through handling beyond what is necessary to establish their nature, characteristics or functionality, we reserve the right to make an appropriate deduction from any refund, as permitted by law.
Every Impact Detect device is fully tested, commissioned, armed and quality-checked prior to dispatch. Due to the technical nature of our products, any device that has been powered on, activated, commissioned, armed, paired, registered, configured, updated, installed, modified, used, damaged, returned with missing accessories, returned in damaged packaging, or returned with broken security seals may no longer be suitable for sale as a new product. Where a return is accepted, we reserve the right to reduce any refund to reflect the actual diminished value of the product or, where permitted by law, refuse the return if the product cannot reasonably be restored to a saleable condition.
Products must not be returned without prior written authorisation from Impact Detect. A valid Returns Authorisation (RA) number must be obtained before any goods are returned. Unauthorised returns may be refused and returned to the sender at the customer’s expense.
Unless the goods are faulty, not as described, or we have agreed otherwise in writing, the customer is responsible for all return shipping costs, insurance, customs duties, import taxes and any other charges associated with returning the goods.
Orders placed by businesses, trade customers or organisations are not subject to statutory consumer cancellation rights. Any cancellation or return accepted after dispatch is entirely at the discretion of Impact Detect and may be subject to a restocking charge of up to 30% of the original purchase price, together with any reasonable costs incurred for inspection, testing, recommissioning, battery replacement, software resetting, recalibration, repackaging and return shipping.
Products that have been manufactured, programmed, configured, calibrated, personalised or otherwise customised to a customer’s specification are non-cancellable and non-returnable once production or configuration has commenced, except where required by applicable law.
Where an order is refused by the customer, returned due to non-payment of customs duties or taxes, failure to collect, or as a result of an incorrect delivery address supplied by the customer, we reserve the right to deduct all outbound shipping costs, return carriage, customs charges, handling costs and any applicable restocking fee from any refund.
Refunds, where applicable, will only be processed after the returned goods have been received, inspected and approved. Any refund will be issued using the original payment method within the timescales required by applicable law.
Nothing in these Terms and Conditions excludes or limits any statutory rights that cannot legally be excluded or restricted.
7. Product Information and Warranty
We take care to describe and display our products accurately; however, we do not guarantee that all details are complete or error-free. Our products are provided with any warranties required by law. To the fullest extent permitted by law, all other warranties, conditions and terms are excluded.
8. Limitation of Liability
To the fullest extent permitted by law, Impact Detect shall not be liable for any indirect, incidental or consequential loss arising from the use of our products or website. Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be limited or excluded under applicable law.
9. Privacy
Your personal data is handled in accordance with our Privacy Policy, which forms part of these terms.
10. Changes to These Terms
We may update these terms and conditions from time to time. Any changes will be posted on this page and will apply to orders placed after the date of the update.
11. Governing Law
These terms and conditions are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
